Covenants
Since Mogollon Estates was laid out with a country flavor in mind, we feel that only minimum restrictions are necessary to provide the freedoms you are looking for . However, some restrictions are necessary in order to provide the best possible living conditions for you and your neighbors. Therefore, the following restrictions will be enforced.
No structure, planting or other material shall be placed or permitted to remain which may change the direction of flow of drainage channels in the easements.
No noxious or offensive activity shall be carried on upon the lot nor shall anything be done thereon which may be or may become an annoyance or nuisance to the development.
No lot shall be used or maintained as a dumping ground for rubbish, trash, garbage, or other waste. Rubbish, trash, garbage or other waste shall not be kept except in a clean and sanitary container.
Only onsite built housing may be located on the properties. Construction plans must be approved by the estate committee prior to beginning of construction. It is not required, however, it is desired that all construction coincide with the southwest flavor.
No permanent trailors, however, a trailor may be located on the property during construction of the permanent home, up to 1 year.
No structure of a temporary character, basement, tent, shack, shed, garage, barn or other outbuilding shall be used on any lot at any time as a residence, either temporarily or permanently. No old or secondhand buildings which are to serve in any capacity shall be moved onto any lot. No junk or inoperative cars are to remain parked on the street or the lots. Camp trailers, campers, boats and boat trailers may be kept on the lot, not to exceed one of each, but may not be used as a residence. Rv's may not be parked on the street and must be parked out of view of the street on the lot itself.
No lot shall be smaller than 10 acres. The premises shall be used only for residential purposes. No more than one home per 10 acre lot will be permitted.
Homes to be built must be 1300 square feet heated area or larger and no home constructed within the subdivision shall contain more than two stories above ground. No building shall be erected, placed or altered on any lot or tract until the construction plans and specifications and a plan showing the location of the structure have been approved by the Architectural Control Committee as to quality of workmanship and materials, harmony of external design with existing structures, and as to location with respect to topography and finish grade elevation.
"A" frame, cubical and dome structures are prohibited as residences or for any other use or purpose.
All on-site construction shall be completed within one year from the start thereof.
No lot shall be resubdivided.
No work or exploration for any minerals, or mining of any minerals or quarrying of any rock, minerals, soil or material of any nature may be conducted on any lot or portion thereof.
Horses & mules are allowed providing they are located within an appropriate corral on your property. No open grazing allowed.
No pigs, goats or sheep may be kept, except as may be bred & raised for 4H school projects.
Dogs & cats must be kept under control of the owner. Any animals harassing other residents or their pets or livestock will be dealt with immediately.
No business or profession, manufacturing, commercial enterprise or public or commercial amusement enterprise shall be conducted, operated or maintained on any lot. This restriction shall not be construed to prohibit home based businesses such as, but not limited to, computer related work, online selling, etc, which do not require a continuous flow of traffic to and away from the business.
The subdivision will contain a wet land park consisting of 10 to 13 acres which shall be owned and maintained by a Home Owners Association, and which may be utilized by lot owners in the subdivision and their guests. The Home Owners Association shall have no right to sell, lease or otherwise dispose of the dedicated wet lands. No vehicles or machinery, other than maintenance equipment and mowers, shall be stored or allowed upon the wet lands park area.
